WHY THE COPYRIGHT REGISTRATION IS NECESSARY:-

• 1) It gives to authors confidence and assurance that their work is not likely to be pilfered.
• 2) It is convenient because the certified copy of the registration being at hand, negotiations for assignment and licensing become easy.
• 3) It is useful in the circumstances of wide ranging uses of artistic works by a variety of communication media, claims for payment of royalties and settlement of accounts might become matters of routine.

TERM OF COPYRIGHT IS SIXTY YEARS:- (Section - 22)

Term for which the copyright subsists is the life time of the author plus sixty years from the calendar year in which the author dies.

Remedies against Infringement:- (Section 54)

The remedies available against infringement are
1) Civil
2) Criminal

Infringement of Copyright:- (Section 51)

In Literary & Artistic Works:-
1).Copying word “per se” amounts to infringement.
2).Copying the work in full or in part amounts to infringement.
3).Adaption and abridgement are also included in copyright. If any person adapts or abridges a copyrighted work without any application of his own mind or judgement of his own, he will be offending the rights of the copyright holder.

In Dramatic Works:
If a substantial number of incidents, scenes and episodes in the infringing play are so nearly identical in detail, combination and arrangement with those found in copyrighted work, it would amount to infringement of the latter.

In Musical Works:
Infringement of musical work occurs in two ways:-
1). By printing and selling copies of the music written down or scripted by its author.
2). By performing the musical work in public for profit.

In Software Work:
If the software is preloaded in computer without a license from the software owner from whom it is purchased or the computer is sold it amounts to infringement of copyright.
